FireAngel Safety Technology take your privacy very seriously. We treat your personal data confidentially and in accordance with the legal data protection regulations as well as this privacy policy. The use of our website is usually possible without providing personal information. As far as on our sides personal data (such as names, addresses, contact numbers and/or e-mail addresses) are collected, this is as far as possible on a voluntary basis. This data is not without your express consent to third parties.
We point out that data transmission over the Internet (e.g. when communicating via email) can have security gaps. A complete protection of data against unauthorised access by third parties is not possible.

Privacy Statement for the Use of Google Analytics

GDPR policy

As we’ve mentioned before data protection and privacy are super important to us. This page has some legal technicalities, but also is underpinned by a genuine concern that we do everything we can to ensure your data is treated with the respect that we would want our data treated.

We have reviewed our data collection and retention policy in line with the General Data Protection Act.  This page provides an overview, if you would like more details please contact us via email gdpr@fireangeltech.com

If you are a customer or supplier, we will have your data stored in a number of other places for the purposes of invoicing, paying bills, delivering projects and offering customer support in compliance with our product warranties. This policy relates specifically to the marketing data collected via this website www.fireangel.co.uk or events we have either hosted or exhibited at. Information collected

We collect personal data from visitors to this website through the use of online forms, email hyperlinks and the contact us page. We collect your details when you email us with an enquiry. We may also have collected your details when we met you at an event, exhibition, trade-show, conference or a networking session.

When you submit your data to us, either through the website, by email or in person, this is collected by HubSpot or Salesforce (our CRM platforms) and is used by us in a variety of ways, specifically:

  • Providing information about products and services
  • Providing and personalising our services
  • Dealing with your enquiries and requests
  • Administering membership of our newsletter distribution list
  • Conducting market research

In all cases our aim is that it is clear what you are opting into and you will have given your consent for us to use your data.

More generally, we do not pass on our data to any third party. If you have attended an event we have showcased at, downloaded a content offer or asked to subscribe to our blogs then we collect your name and email address and use this to send out news and information from FireAngel. You can unsubscribe from the mailing list at any time, either by using the unsubscribe feature on the very bottom of every email sent or by emailing gdpr@fireangeltech.com stating ‘UNSUBSCRIBE’ in the subject line of your email.

HubSpot and Salesforce are our client relationship management tools and both collect and store your data securely.

HubSpot is a cloud-based provider with a significant European customer base and impressive commitment to GDPR. More about the HubSpot commitment to data protection.

We will not share your data with third parties unless we are obliged to disclose personal data by law, or the disclosure is necessary for purposes of national security, taxation and criminal investigation, or we have your consent.

Data retention and deletion
From May 2018, our policy is to retain data for ten years, if we have not substantive contact with you over a two-year period then we will delete your record from our database unless you have purchased product from us in which we will need to retain your information for a minimum of warranty period. We are the “controller” of personal data we collect from you or you provide to us. The personal data we collect may include:

technical information, comprising the type of Product you use, a unique product identifier (for example, the serial number and/or model number of the Product) the MAC address of the Product’s network interface, IP address, network information, time zone setting, Product Software version number (“Product Information“);

details about the operation of the Product and/or the Product Software, comprising the activation state of the Product (i.e. whether it is turned on, connected to our network and operating within normal parameters (which is determined solely by us)), the dates and times at which the alarm in the Product has been triggered (e.g. by smoke or carbon monoxide) and if and when the alarm in the Product has been silenced subsequently, the dates and times at which the “test” button on the Product has been pressed, battery charge level and other diagnostic information about the Product and its performance (“Operational Information“).

 

This personal data will be collected automatically during the normal operation of the Product (via the Product Software and the Service).

Information we receive from other sources (“Third Party Information”) We work closely with other parties (including, for example, Contract Service Providers, technical services providers and distributors of the Product) to enable us to monitor the quality of our products and their operation and we may receive information from those other parties about you, about the Product, the Product Software and/or the Service.

 

The personal data provided to us may include: your first and last names, your email address and/or your correspondence address, your Product serial number and information about correspondence/contact you have had with them concerning the Product, the Product Software and/or the Service and/or its/their operation.

 

This personal data will be provided to us by third parties, including the entity who installed the Product in the premises where it is located.

We need to collect the above personal data, so that the Product can perform its function and so that we can provide the Service. If you do not provide the above personal data to us, it may prevent the Product and Product Software from operating correctly and it may delay or prevent us from providing the Service.

  1. HOW AND WHY WE USE YOUR PERSONAL DATA

Under the GDPR, we can only use your personal data if we have a legal basis for doing so. The legal basis on which we use your personal data is that the use of your personal data described in the table below is necessary for the performance of that contract with you or to take steps, at your request, before entering into that contract (i.e. your agreement to the End User Licence Agreement [INSERT AS LINK TO END USER LICENCE AGREEMENT] forms a contract between you and us, under which we are legally bound to provide the Service (subject to the terms and conditions set out in the End User Licence Agreement [INSERT AS LINK TO END USER LICENCE AGREEMENT])).

For example, the Product Software will tell us the number of times the alarm in the Product is triggered and subsequently silenced over a period of time and we will use the information we gather to understand the frequency of risk patterns where fire/temperature/CO risk is identified;

in the event that the alarm in the Product is triggered, send automated notifications to you (including “push” notifications, where you have indicated you would like to receive them (i.e. by ticking the push notification’s check box in your device settings)) via a mobile software application (if you have downloaded and installed the same on a mobile device) and/or to a third party email address (nominated by you);

analyse faults with the Product that are reported to us via the Service and to provide customer assistance in respect of such faults in accordance with any applicable warranty in respect of the Product;

develop and/or improve the technical operation and/or quality of our products/services and/or any software used in connection with our products/services.

receive alerts about faults that have arisen with the Product;

receive alerts about the dates and times at which the alarm in the Product has been triggered;

This is so that the Contract Service Provider can:

notify you if the Product is not connected to our network,

notify you if the Product has developed a fault;

send you email notifications about the dates and times at which the alarm in the Product has been triggered;

(if you have registered the Fire Angel Wi-Safe Connect App) send push notifications to the Fire Angel Wi-Safe App about the dates and times at which the alarm in the Product has been triggered; and/or

notify you to remind you to test your Product.

The entity from whom the Contract Service Provider purchased your Product (“Distributor“): we will disclose this data to the Distributor so that they can:

provide you with customer service and support in relation to the Product, the Product Software and/or the Service, if and when you contact us/them and ask us/them to do so;

communicate/correspond with us about customer service and support issues, faults and/or maintenance issues you are experiencing / have experienced in respect of the Product, the Product Software and/or the Service.

We may need to share your personal data with other third parties:

  • where disclosure of the information is in our legitimate interests (i.e. for the success, growth and protection of our business), including:
  • with prospective sellers or buyers of businesses or assets, if we plan to sell or buy any business or assets, but we will only do so after the prospective seller or buyer has entered into an agreement with us to protect the confidentiality and security of your personal data;
  • if Fireangel Safety Technology Limited or substantially all of its assets are acquired by a third party, in which case personal data held by it about users of the Product/Product Software/Service will be one of the transferred assets;
  • in order to enforce or apply the EULA and/or any other agreements or to investigate potential breaches and/or to protect the rights, property or safety of Fireangel Safety Technology Limited, our customers, or others.

We may allow other IT service providers to handle your personal data if we are satisfied that we have a legal basis to share the same with them and they take appropriate measures to protect your personal data.

  1. WHERE WE STORE YOUR PERSONAL DATA

Personal data you provide to us by corresponding with us by telephone, email or otherwise howsoever will be filed and stored at our offices (at Fireangel Safety Technology Limited, Vanguard Centre, Coventry, CV4 7EZ).

Information which we collect from and about you (including Submitted Information, Product Information and Operational Information) will also be stored using the Amazon Cloud service, via an account which we control and administer. The information stored using the Amazon Cloud service is a distributed cloud platform, and therefore the information we collect is not stored at one specific address. Nevertheless, all the information you provide to us and which we collect will be stored at a destination within the European Economic Area (“EEA”).

  1. HOW LONG WE WILL KEEP YOUR PERSONAL DATA

We will hold your personal data for the following duration:

  • Submitted Information: For as long as your subscription to the FireAngel connect system (i.e. the Service) remains live, plus 3 years;
  • Product Information: For as long as your subscription to the FireAngel connect system (i.e. the Service) remains live, plus 3 years;
  • Operational Information: For as long as your subscription to the FireAngel connect system (i.e. the Service) remains live, plus 3 years;
  • Third Party Information: For as long as your subscription to the FireAngel connect system (i.e. the Service) remains live, plus 3 years.

We will not retain and process your personal data other than for the purposes set out in this Privacy Notice.

When it is no longer necessary to retain your personal data, we will delete or anonymise it.

  1. YOUR RIGHTS

You have the following rights in respect of your Personal Data, which you can exercise free of charge (unless your request is manifestly unfounded or excessive, in which case we may charge you a reasonable fee or refuse to act on the request):

Information we collect via the Product, Product Software and the Service

(“Product Information” and “Operational Information”)

The personal data we collect may include:

technical information, comprising the type of Product you use, a unique product identifier (for example, the serial number and/or model number of the Product) the MAC address of the Product’s network interface, IP address, network information, time zone setting, Product Software version number (“Product Information“);

details about the operation of the Product and/or the Product Software, comprising the activation state of the Product (i.e. whether it is turned on, connected to our network and operating within normal parameters (which is determined solely by us)), the dates and times at which the alarm in the Product has been triggered (e.g. by smoke or carbon monoxide) and if and when the alarm in the Product has been silenced subsequently, the dates and times at which the “test” button on the Product has been pressed, battery charge level and other diagnostic information about the Product and its performance (“Operational Information“).

 

This personal data will be collected automatically during the normal operation of the Product (via the Product Software and the Service).

We need to collect the above personal data, so that the Product can perform its function and so that we can provide the Service. If you do not provide the above personal data to us, it may prevent the Product and Product Software from operating correctly and it may delay or prevent us from providing the Service.

  1. HOW AND WHY WE USE YOUR PERSONAL DATA

Under the GDPR, we can only use your personal data if we have a legal basis for doing so. The legal basis on which we use your personal data is that the use of your personal data described in the table below is necessary for the purposes of our legitimate interests (i.e. for the success, growth and protection of our business) and/or for the purposes of the legitimate interests of the owner of the Premises (i.e. for the operation of the Product and the safety of the Premises.

We use the information we collect about you (i.e Submitted Information, Product Information  and Operational Information) in the following ways:

Used by us, so that we can:

identify the Product on our network (and distinguish it from other products on our network);

monitor the Product and its operation and use in connection with the Service. We will use the information gathered on an aggregated and anonymised basis to ascertain behaviour patterns in respect of the use made of and/or interaction with the Product from time to time. For example, the Product Software will tell us the number of times the alarm in the Product is triggered and subsequently silenced over a period of time and we will use the information we gather to understand the frequency of risk patterns where fire/temperature/CO risk is identified;

in the event that the alarm in the Product is triggered, send automated notifications to you (including “push” notifications, where you have indicated you would like to receive them (i.e. by ticking the push notification’s check box in your device settings)) via a mobile software application (if you have downloaded and installed the same on a mobile device) and/or to a third party email address (nominated by you);

analyse faults with the Product that are reported to us via the Service and to provide customer assistance in respect of such faults in accordance with any applicable warranty in respect of the Product;

develop and/or improve the technical operation and/or quality of our products/services and/or any software used in connection with our products/services;

provide you with customer service and support in relation to the Product, the Product Software and/or the Service, if and when you contact us and ask us to do so;

monitor the quality of our products, their operation and/or our products’ compliance with applicable laws and regulations;

contact the Premises owner or the installer of the Product about issues/faults with/the performance of the Product, the Product Software and/or the Service.

We may also use the information you provide to us in an aggregated and anonymous form for research purposes and to help us make development, marketing, sales and/or other business decisions.

We may associate/combine any category of information with any other category of information (for example, we may associate/combine Submitted Information with Operational Information) and will treat the combined information as personal data in accordance with this Privacy Notice for as long as it is combined.

At any time during which the Product, the Product Software and/or the Service are in use, we may disclose some or all of the data we collect from you to the following third parties:

Contract Service Provider: We will disclose this data to the Contract Service Provider via our FireAngel Connect software, which will allow the Contract Service Provider to access, process, analyse and/or store the data for the purposes of enabling them to perform any contract they have entered into with the owner of the Premises and to:

monitor the operational status and usage of the Product;

receive alerts about faults that have arisen with the Product;

receive alerts about the dates and times at which the alarm in the Product has been triggered;

monitor the dates and times at which the “test” button on the Product has been tested.

This is so that the Contract Service Provider can notify the owner of the Premises:

if the Product is not connected to our network;

if the Product has developed a fault;

about the dates and times at which the alarm in the Product has been triggered;

with reminders to test the Product.

Product Information

Operational Information

 

The entity from whom the Contract Service Provider purchased the Product (“Distributor“): we will disclose this data to the Distributor so that they can:

provide customer service and support in relation to the Product, the Product Software and/or the Service, if and when you contact us/them and ask us/them to do so;

communicate/correspond with us about customer service and support issues, faults and/or maintenance issues you are experiencing / have experienced in respect of the Product, the Product Software and/or the Service.

We may need to share your personal data with other third parties:

  • where disclosure of the information is in our legitimate interests (i.e. for the success, growth and protection of our business), including:
  • with prospective sellers or buyers of businesses or assets, if we plan to sell or buy any business or assets, but we will only do so after the prospective seller or buyer has entered into an agreement with us to protect the confidentiality and security of your personal data;
  • if Fireangel Safety Technology Limited or substantially all of its assets are acquired by a third party, in which case personal data held by it about users of the Product/Product Software/Service will be one of the transferred assets;
  • in order to enforce or apply the EULA and/or any other agreements or to investigate potential breaches and/or to protect the rights, property or safety of Fireangel Safety Technology Limited, our customers, or others.
  • where disclosure of the information is necessary for compliance with a legal obligation to which we are subject, including:
  • if we are under a duty to disclose or share your personal data in order to comply with any legal or regulatory obligation or request, in which case we may have to disclose your personal data to law enforcement agencies and regulatory authorities.

We may allow other IT service providers to handle your personal data if we are satisfied that we have a legal basis to share the same with them and they take appropriate measures to protect your personal data.

  1. WHERE WE STORE YOUR PERSONAL DATA

Personal data you provide to us by corresponding with us by telephone, email or otherwise howsoever will be filed and stored at our offices (at Fireangel Safety Technology Limited, Vanguard Centre, Coventry, CV4 7EZ).

Information which we collect from and about you (including Submitted Information, Product Information and Operational Information) will also be stored using the Amazon Cloud service, via an account which we control and administer. The information stored using the Amazon Cloud service is a distributed cloud platform, and therefore the information we collect is not stored at one specific address. Nevertheless, all the information you provide to us and which we collect will be stored at a destination within the European Economic Area (“EEA”).

  1. HOW LONG WE WILL KEEP YOUR PERSONAL DATA

We will hold your personal data for the following duration:

  • Submitted Information: For as long as the owner of the Premises’ subscription for the FireAngel Connect system (i.e. the Service) remains active, plus 3 years;
  • Product Information: For as long as the owner of the Premises’ subscription for the FireAngel Connect system (i.e. the Service) remains active, plus 3 years;
  • Operational Information: For as long as the owner of the Premises’ subscription for the FireAngel Connect system (i.e. the Service) remains active, plus 3 years.

We will not retain and process your personal data other than for the purposes set out in this Privacy Notice.

When it is no longer necessary to retain your personal data, we will delete or anonymise it.

  1. YOUR RIGHTS

You have the following rights in respect of your Personal Data, which you can exercise free of charge (unless your request is manifestly unfounded or excessive, in which case we may charge you a reasonable fee or refuse to act on the request):

We have appropriate security measures to prevent your personal data from being accidentally lost, or used or accessed unlawfully. Those processing your information will do so only in an authorised manner and are subject to a duty of confidentiality.

We have procedures in place to deal with any suspected data security breach. We will notify you and any applicable regulator of a suspected data security breach where we are legally required to do so.

THIS IS A LEGAL AGREEMENT. PLEASE READ THIS END USER LICENCE AGREEMENT (“EULA”) CAREFULLY TO MAKE SURE YOU UNDERSTAND IT BEFORE TICKING THE “TICK BOX” AND PROCEEDING.
We allow you to use the App and Documents (as defined below) on the basis of this EULA and any rules or policies applied by any appstore provider or operator from whose site (for example, the appstore operated by Apple, Inc) you downloaded the App (“Appstore” and ”Appstore Rules” respectively). We do not sell the App or Documents to you. We remain the owners of the App and Documents at all times.

THIS EULA:
•       TELLS YOU INFORMATION ABOUT US;
•       TELLS YOU THE TERMS AND CONDITIONS RELATING TO YOUR USE OF THE FIREANGEL WI-SAFE MOBILE APPLICATION SOFTWARE (VERSION [1.0] AND ANY UPDATES, FUTURE VERSIONS OR SUPPLEMENTS) AND ASSOCIATED SERVICES (“App”) AND ANY ELECTRONIC DOCUMENTS PROVIDED BY US WITH OR FORMING PART OF THE APP (“Documents”);
•       TELLS YOU THE TERMS AND CONDITIONS RELATING TO THE FIREANGEL WI-SAFE CONNECT SERVICE, MADE AVAILABLE TO YOU AND ACCESSED VIA THE APP (“Service”) AND THE SOFTWARE THAT IS EMBEDDED IN THE FIREANGEL WI-SAFE GATEWAY PRODUCT (“Product Software” AND “Product” RESPECTIVELY);
•       PLACES CERTAIN RESPONSBILIITES ON YOU RELATING TO YOUR USE OF THE PRODUCT, THE PRODUCT SOFTWARE, THE SERVICE, THE APP AND THE DOCUMENTS. THEY ALSO EXCLUDE AND LIMIT OUR LIABILITY YOU IN THE EVEND OF LOSS OR DAMAGE (SEE CLAUSE 12).

AGREED TERMS:-

1.               Linking the App with the Product
1.1.        In order to link the App with your Product, you will need to:
1.1.1.     download the App from the App Store;
1.1.2.     follow the in-App set-up procedure (which will include providing us with your first name, last name, address and a contact email address).
1.2.        It is your responsibility to:
1.2.1.     ensure that the Device meets the Operating System Requirements;
1.2.2.     obtain and maintain in good order your own network connections and telecommunications links from your Device, the Product and your IT systems to ours.

2.               Limitations of the Product, the App, the Product Software and the Service
2.1.        You recognise that the Product, the App, the Product Software, the Service and/or we will not (and we give no warranty, representation or assurance that we will):
2.1.1.     notify any emergency service if the alarm in the Product is triggered;
2.1.2.     notify you in the event that we receive data from the Product, that does or may indicate that the Product/Product Software is faulty or operating outside its normal parameters;
It is your responsibility to take any action you consider are necessary upon receipt of any of the notifications described in clauses 3.1.2.4 to 3.1.2.6 (inclusive).
2.2.        You recognise that when the Service monitors patterns of behaviour when the Product and Service are in use (i.e. the “Predict” Service) we give no warranty, representation or assurance that the Product, the Service, the Product Software or we will identify or notify you of all risks of fire, changes in risk of fire and/or higher risks of fire. 1.1.
2.3.        You recognise that for as long as you fail to comply with clause 1.1, then we will be unable to, have no obligation to, and have no responsibility to you for failing to provide the Service and you accept that the Product will not work until you have complied with clause 1.1.
2.4.        Any delay or failure of the Product, the Product Software, the App and/or the Service arising from or relating to your network or telecommunications links or caused by the Internet shall not be our responsibility and we shall have no liability to you for the same.

3.               The App and the Service
3.1.        From the date of this EULA (i.e. the date on which you click the “accept” button, signifying your agreement to this EULA, when prompted to do so) unless and until the EULA is terminated by you or us as described in clauses 9 or 10 (“Term”), we:
3.1.1.     grant you a non-transferable, non-exclusive licence to use the App on a Device, subject to the terms of this EULA and the Appstore Rules. You may:
3.1.1.1.      download one copy of the App onto one Device, in order to view, use and display the App on the Device (and to access the Service) for your personal purposes only; and
3.1.1.2.      access and use the Documents for your personal purposes in connection with your use of the App only.
3.1.2.     will provide the Service. The Service will comprise:
3.1.2.1.      allowing the Product connect to our network and activating the Product and Product Software promptly (i.e. within not more than 24 hours after that connection has been established) when you have taken the steps described in clause 1.1;
3.1.2.2.      linking the Product with the App when you have taken the steps described in clause 1.1;
3.1.2.3.      (after the Product has been connected to the network and the Product and Product Software have been activated) receiving data from the Product via the Product Software and the App and storing and hosting that data on our servers;
3.1.2.4.      notifying you via the App if the Product has lost connection to our network;
3.1.2.5.      notifying you via the App if the Product has developed a fault;
3.1.2.6.      notifying you via the App about the dates and times at which the alarm in the Product has been triggered;
3.1.2.7.      allowing you to view the history of your Product network (for example, the dates and times at which notifications under clauses 3.1.2.4, 3.1.2.5 and/or 3.1.2.6 have been sent to you) via the App;
3.1.2.8.      allowing you to view the last time alarms connected to the Product were tested via the App;
3.1.2.9.      turn off or turn on Product notifications via the App; and
3.1.2.10. making information available to you (via URLs displayed in the App), comprising Product information, Product datasheets, Product manuals, information on troubleshooting and frequently asked questions.

4.               Restrictions relating to your use of the Product Software
4.1.        You may use the Product Software only together with and for the purposes of using of the Product. Unless expressly stated elsewhere in this EULA, or the terms of any open source software licence (in respect of any open source software contained in the Product Software), or as permitted by any local applicable law, you will not (and you will not enable, instruct, encourage or otherwise allow other person to):
4.1.1.     use the Product Software (in whole or in part) on any device or computer other than the Product that you own or control;
4.1.2.     copy, adapt, reverse engineer, decompile, disassemble, modify, translate, duplicate, create derivative works from, frame, mirror, republish, transmit, distribute, merge or make error corrections to the Product Software (in whole or in part), except as permitted by statute or regulation for the purposes of interoperability;
4.1.3.     remove, amend or hide any proprietary or other notices of Fireangel Safety Technology Limited that are contained in the Product Software;
4.1.4.     rent, lease, dispose of, sub-licence or loan the Product Software (in whole or part); and/or
4.1.5.     provide, or otherwise make available, the Product Software in any form (in whole or in part) to any person,
together “Product Software Restrictions”.

5.               Restrictions relating to your use of the App
Except as expressly stated elsewhere in this EULA, or as permitted by any applicable local law, you will not:
5.1.1.     copy the App or Documents (in whole or in part), except where such copying is incidental to normal use of the App, or where it is necessary for the purpose of back-up or operational security;
5.1.2.     rent, lease, dispose of, sub-licence or loan the App or Documents (in whole or in part);
5.1.3.     make alterations to, or modifications of, the whole or any part of the App, or permit the App or any part of it to be combined with, or become incorporated in, any other programs;
5.1.4.     copy, adapt, reverse engineer, decompile, disassemble, translate, duplicate, create derivative works from, frame, mirror, republish, transmit, distribute, merge or make error corrections to the whole or any part of the App or attempt to do any such thing except to the extent that (by virtue of section 296A of the Copyright, Designs and Patents Act 1988) such actions cannot be prohibited because they are essential for the purpose of achieving inter-operability of the App with another software program;
5.1.5.     remove, amend or hide any proprietary or other notices of Fireangel Safety Technology Limited that are contained in the App or the Documents; and/or
5.1.6.     provide or otherwise make available the App in whole or in part (including object and source code), in any form to any person,
together “Licence Restrictions”.

6.               Acceptable use restrictions
You must not:
6.1.1.     use the App, the Product or the Service in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with this EULA, or act fraudulently or maliciously, for example, by hacking into or inserting malicious code, including viruses, or harmful data, into the App, the Product Software, the Service or any operating system;
6.1.2.     infringe our intellectual property rights or those of any third party in relation to your use of the Product, the Product Software, the App, the Documents or the Service (to the extent that such use is not licensed by this EULA);
6.1.3.     transmit any material that is defamatory, offensive or otherwise objectionable in relation to your use of the Product, the Product Software, the App, the Documents, or the Service;
6.1.4.     use the Product, the Product Software, the App, the Documents or the Service in a way that could damage, disable, overburden, impair or compromise our systems or security or interfere with other users; and
6.1.5.     collect or harvest any information or data from the Service or our systems or attempt to decipher any transmissions to or from the servers running the Service, unless you have to do so for the purposes of the normal use and function of the Product Software or the App.

7.               Installing the Product in premises where other people will use/interact with the Product - YOUR ATTENTION IS DRAWN PARTICULARLY TO THIS CLAUSE
7.1.        If you:
7.1.1.     install the Product in premises where other people will use/interact with the Product (for example, if you install the Product in a property which is leased to a third party). you must (promptly following their taking up residence at / occupation of the premises in question) provide us with the email contact details of all such persons so that we can provide them with a copy of our Privacy Notice shown below. This is so that we notify them of the purposes for, and manner in which, we will collect, hold and process their personal data.
7.1.2.     provide us (e.g. via the App) with the email address of the third party or parties, to whom you would like us to send notifications about the Product (i.e. of the type described in clauses 3.1.2.4, 3.1.2.5 and 3.1.2.6).

7.2.        You will inform us immediately if any person living at the premises at which the Product has been installed or any person nominated by you pursuant to clause 7.1.2 objects to the collection and/or use of their personal data as described in our Privacy Notice and you shall follow any lawful instructions and/or directions we give to you in addressing that objection (including, without limitation, turning the Product off until further notice).

7.3.        You hereby indemnify us (which means you must reimburse us on a £ for £ basis) in respect of all damages, losses, penalties, fines, costs and/or expenses that we suffer or incur as a result of you failing to comply with your responsibilities under clauses 7.1 and/or 7.2

8.                Product Software Updates
From time to time, we may develop patches, bug fixes, updates and other modifications to improve the performance of the Product Software (“Updates”). Updates may be remotely and automatically downloaded and installed onto the Product without providing any notice to you or obtaining any additional consent from you and you hereby consent to the automatic download and installation onto the Product of such Updates. If you do not consent to such Updates, you should cease and desist from using the Product Software (which will prevent you from being able to use the Product).

9.               Your rights to terminate this EULA
9.1.        You may terminate this EULA and the Service for any reason, at any time, and with immediate effect by:
9.1.1.     permanently disconnecting the Product from the Internet and uninstalling the Product; and
9.1.2.     permanently deleting the App from your Device.

10.           Our rights to terminate this EULA
10.1.    We may terminate this EULA and the Service at any time and with immediate effect by giving written notice to you (using the email address you gave to us during the in-App set-up process)  if you:
10.1.1.breach any of the Product Software Restrictions, Licence Restrictions or Acceptable Use Restrictions;
10.1.2.use the Product, the Product Software, the App, the Documents and/or the Service in any manner which is not permitted by this EULA; or
10.1.3.have not complied with the requirements of clause 7.
10.2.    We may terminate the EULA and the Service at any time by giving you 12 months’ prior written notice of the same. You recognise and agree that this is reasonable because the price of the Product is calculated on the basis that the Service will only be provided for a limited period of time.

11.           Consequences of termination
11.1.    On termination for any reason:
11.1.1.all rights granted to you under this EULA shall come to an end;
11.1.2.you shall end all activities authorised by this EULA;
11.1.3.you shall immediately and permanently:
11.1.3.1. delete the App from your Device; and
11.1.3.2. disconnect and uninstall the Product from your property.

12.           Our responsibility for loss or damage suffered by you – YOUR ATTENTION IS DRAWN TO THIS CLAUSE
12.1.    If we fail to comply with this EULA, we are responsible for costs, loss or damage you suffer that is a natural, foreseeable consequence of our breach of this EULA or our failing to use reasonable case and skill, but we are not responsible for any costs, loss or damage that is not so foreseeable or preventable (for example, payments due from you to any third party under any contract or arrangement). Loss or damage is foreseeable if it was obvious that it will happen or if, at the time the EULA was entered into, both we and you knew it might happen, for example if we discussed it with you before you started using the Product, the Service or the App.
12.2.    You acknowledge and accept that you must take steps to mitigate any costs, losses and/or damages that you may suffer if we fail to comply with this EULA.
12.3.    As you are a consumer, you agree not to use the Product, the Product Software, the App, the Documents and/or the Service for any commercial, business or re-sale purposes, and in any event we will have no liability to you for any loss of profit or revenue, loss of enjoyment, loss of or damage to reputation or goodwill, loss of business, business interruption, or loss of business opportunity.
12.4.    We do not in any way exclude or limit our liability for:
12.4.1.death or personal injury caused by our negligence or that of our employees, agents or subcontractors;
12.4.2.fraud or fraudulent misrepresentation;
12.4.3.any liability or responsibility that cannot be excluded or restricted under section 57 of the Consumer Rights Act 2015;
12.4.4.defective products under the Consumer Protection Act 1987;
12.4.5.any other liability for which it would be unlawful for us to attempt to limit or exclude our liability.

13.           Intellectual property rights
13.1.    You acknowledge that all intellectual property rights in the Product, the Product Software, the App, the Documents and/or the Service belong to us or our licensors, and you shall have no rights in or in respect of the Product, the Product Software, the App, the Documents and/or the Service, other than the right to use them in accordance with their normal use and the terms of this EULA.

14.           Events outside our control
14.1.    We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under this EULA that is caused by an Event Outside Our Control.
14.2.    An Event Outside Our Control includes any act, event, non-happening, omission or accident outside our reasonable control and includes in particular (without limitation) the following:
14.2.1.strikes, lock-outs or other industrial action;
14.2.2.civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war;
14.2.3.fire, explosion, storm, flood, earthquake, subsidence, epidemic or other natural disaster or act of God;
14.2.4.impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport;
14.2.5.impossibility of the use of public or private telecommunications networks;
14.2.6.the acts, decrees, legislation, regulations or restrictions of any government;
14.2.7.denial of service attacks or other types of attacks that are directed toward the infrastructure that supports the Site;
14.2.8.any type of outage or service degradation relating to the unavailability of a financial institution including, but not limited to, issuers and/or acquirers or any third party switch or processing system;
14.2.9.any issues which are limited solely to you and which cannot be proven against any of our other customers; or
14.2.10.    any failure or service outage that falls outside of our control.
14.3.    Our performance under this EULA is deemed to be suspended for the period that the Event Outside Our Control continues, and we will have an extension of time for performance for the duration of that period. We will use our reasonable endeavours to bring the Event Outside Our Control to a close or to find a solution by which our obligations under the Contract may be performed despite the Event Outside Our Control.
14.4.    If an Event Outside Our Control takes place that affects the performance of our obligations under a Contract, we will endeavour to contact you as soon as reasonably possible to notify you.

15.           Communications between us
15.1.    When we refer, in this EULA, to “in writing”, this will include email unless it is clear that email is not intended to be included in any particular scenario.
15.2.    Applicable laws require that some of the information or communications we send to you should be in writing. You accept that communication between you and us will be mainly electronic. We will contact you by email, to the email address you gave to us during the in-App set-up process and we may provide you with information about the Product, the Product Service, the App or the Service by posting notices our website at www.fireangel.co.uk For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you electronically comply with any legal requirement that such communications be in writing. This condition does not affect your statutory rights.
15.3.    All notices given by you to us must be given in writing in the English language. You can send notices to us by email at customersupport@fireangeltech.com or by pre-paid post to FireAngel Safety Technology Limited Vanguard Centre, Sir William Lyons Road, Coventry, CV4 7EZ. In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped with the correct postage paid and placed in the post and, in the case of an email, that such email was sent to the specified email address of the addressee.

16.           Other important terms
16.1.    We may transfer this EULA to someone else. We may transfer our rights under this EULA to another organisation, but this will not affect your rights or obligations under these Conditions. You may only transfer your obligations under this EULA to another person, if we agree in writing.
16.2.    Nobody else has any rights under this EULA. This EULA is between you and us. No other person shall have any rights to enforce any terms of this EULA.
16.3.    If a court finds part of this EULA illegal, the rest will continue in force. Each of the clauses of this EULA operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining clauses (and part clauses, where relevant) will remain in full force and effect.
16.4.    Even if we delay in enforcing this EULA, we can still enforce its terms later. If we do not insist immediately that you do anything you are required to do under this EULA, or if we delay in taking steps against you in respect of your breaking the EULA, that will not mean that you do not have to do those things or prevent us taking steps against you at a later date.
16.5.    Which laws apply to this EULA and where you may bring legal proceedings. This EULA is governed by English law and you or we can bring legal proceedings in respect of this EULA, the Product, the Product Software, the App, the Documents and/or the Service in the English courts. If you live in Scotland you or we can bring legal proceedings in respect of this EULA, the Product, the Product Software, the App, the Documents and/or the Service in the English courts in either the Scottish or the English courts. If you live in Northern Ireland, you or we can bring legal proceedings in respect of this EULA, the Product, the Product Software, the App, the Documents and/or the Service in the English courts in either the Northern Irish or the English courts.

16.6.    Alternative dispute resolution. Alternative dispute resolution is a process where an independent body considers the facts of a dispute and seeks to resolve it, without you having to go to court. If you are not happy with how we have handled any complaint or we fail to resolve a dispute between us in relation to this EULA, the Product, the Product Software, the App, the Documents and/or the Service in the English courts you may want to contact The Retail Ombudsman, who is certified ADR provider with whom we are willing to work. Further information about The Retail Ombudsman is available on their website at http://www.theretailombudsman.org.uk. We are also required to provide you with a link to the European Commission’s Online Dispute Resolution (ODR) platform: http://ec.europa.eu/consumers/odr/.

 

FireAngel Wi-Safe Gateway – Product Privacy Notice

We take your privacy very seriously. We ask that you read this privacy notice carefully. It sets out important information about the operation of your Fire Angel Wi-Safe Gateway product and about:
•      who we are;
•      how and why we collect, store, use and share information about you (known as “personal data”);
•      how long we will keep your personal data;
•      your rights in relation to your personal data;
•      how to contact us (and supervisory authorities) if you have a complaint.

1.      WHO WE ARE
FireAngel Safety Technology Limited is a private limited company, registered under the laws of England and Wales, with company number 3641019 and whose registered address is Vanguard Centre, Sir William Lyons Road, Coventry, CV4 7EZ

We are the “controller” of personal data we collect from you or you provide to us. This means that when we collect and use your personal data, we are responsible for ensuring that your personal data is lawfully and properly processed and our conduct is regulated by the UK General Data Protection Regulation Our registration number under the Data Protection Public Register is ZA062715.

When the following words with capital letters are used in this Privacy Notice, this is what they mean:

Contract Service Provider means the entity that installed the Product in the Premises
Premises means the premises at which the Product has been installed and in which it operates.
Product means the FireAngel Wi-Safe Gateway product.
Product Software means the software that is embedded in the Product, which enables it to function.
Service means the FireAngel Wi-Safe Connect service
“we” “us” and “our” means FireAngel Safety Technology Limited.

2.      PERSONAL DATA WE MAY COLLECT FROM YOU
The following table explains what personal data we will or may collect about you and how it will be collected.

What the personal data is and how it is collected:
The personal data you give us may include: your first and last names, address, e-mail address, telephone number, country of residence, enquiries you submit to us about the Product, the Product Software, the App and/or the Service, information about problems/defects you are experiencing with the Product, the Product Software, the App and/or the Service and/or details relating to why you are corresponding with/contacting us.

We may collect this personal data:
•    when you fill in and submit (i.e. via the Internet) forms we ask you to complete in relation to the Product, the Product Software and/or the Service;
•    by corresponding or communicating with us, including by telephone, by letter or by email.

We need to collect the above personal data, so that the Product and the App can perform their function and so that we can provide the Service. If you do not provide the above personal data to us, it may prevent the Product, the Product Software and/or the App from operating correctly and it may delay or prevent us from providing the Service.

Category of personal data: Information we collect via the Product, Product Software, the App and/or the Service

What the personal data is and how it is collected:

The personal data we collect may include:
•    technical information, comprising the type of Product you use; your IP address; the activation state of the Product (i.e. whether the Product is turned on, connected to our network and operating within normal parameters (which is determined solely by us)); the dates and times at which the alarm in the Product has been triggered (e.g. by smoke or carbon monoxide) and if and when the alarm in the Product has been silenced subsequently; and the dates and times at which the “test” button on the Product has been pressed.

3.      HOW AND WHY WE USE PERSONAL DATA
Under the GDPR, we can only use your personal data if we have a legal basis for doing so. The legal basis on which we use your personal data is as follows: It is necessary for the purposes of our legitimate interests (i.e. for the success, growth and protection of our business and safe functioning and further development of our products) and/or for the purposes of the legitimate interests of the owner of the Premises (i.e. for the operation of the Product and the safety of the Premises and for the safety of persons living at the Premises). See Article 6(1)(f) GDPR.
We use the information we collect about you as set out below.

How and why we use your personal data

We process your personal data in order to:

• identify the Product on our network (and distinguish it from other products on our network);
• monitor the Product and its operation and use in connection with the Service. We will use the information gathered on an aggregated and anonymised basis to ascertain behaviour patterns in respect of the use made of and/or interaction with the Product from time to time (i.e. when our “Predict” service is in use). For example, the Product Software will tell us the number of times the alarm in the Product is triggered and subsequently silenced over a period of time and we will use the information we gather to understand the frequency of risk patterns where fire/temperature/CO risk is identified;
• in the event that the alarm in the Product is triggered, send automated notifications to you (including “push” notifications, where you have indicated you would like to receive them (i.e. by ticking the push notification’s check box in your device settings)) via a mobile software application (if you have downloaded and installed the same on a mobile device) and/or to a third party email address (nominated by you);
• analyse faults with the Product that are reported to us via the Service and to provide customer assistance in respect of such faults in accordance with any applicable warranty in respect of the Product;
• develop and/or improve the technical operation and/or quality of our products/services and/or any software used in connection with our products/services;
• provide you with customer service and support in relation to the Product, the Product Software and/or the Service, if and when you contact us and ask us to do so;
• monitor the quality of our products, their operation and/or our products’ compliance with applicable laws and regulations;
• contact the Premises owner or the installer of the Product about issues/faults with/the performance of the Product, the Product Software and/or the Service.

We may also use the information you provide to us in an aggregated and anonymous form for research purposes and to help us make development, marketing, sales and/or other business decisions.

4.      DISCLOSURE OF YOUR INFORMATION
At any time during which the Product, the Product Software and/or the Service are in use, we may disclose some or all of the data we collect from you to the following third parties:

The owner of the Premises: We will disclose this data to the owner of the Premises via the Service, which will allow the owner of the Premises to access, process, analyse and/or store the data for the purposes of enabling them to:
• monitor the operational status and usage of the Product;
• receive alerts about faults that have arisen with the Product;
• receive alerts about the dates and times at which the alarm in the Product has been triggered;
• monitor the dates and times at which the “test” button on the Product has been tested.
The said data may also be disclosed to the owner of the Premises in circumstances where the owner of the Premises has linked the Service to an Amazon Alexa enabled device (see below in relation to data we may disclose to Amazon).
This is so that the owner of the Premises can:
• notify you if the Product is not connected to our network;
• notify you if the Product has developed a fault;
• notify you to remind you to test the Product.

Contract Service Provider: We will disclose this data to the Contract Service Provider via our FireAngel Connect software, which will allow the Contract Service Provider to access, process, analyse and/or store the data for the purposes of enabling them to perform any contract they have entered into with the owner of the Premises and to:
• monitor the operational status and usage of the Product;
• receive alerts about faults that have arisen with the Product;
• receive alerts about the dates and times at which the alarm in the Product has been triggered;
• monitor the dates and times at which the “test” button on the Product has been tested.
This is so that the Contract Service Provider can notify the owner of the Premises:
• if the Product is not connected to our network;
• if the Product has developed a fault;
• about the dates and times at which the alarm in the Product has been triggered; with reminders to test the Product.

Customer Support Provider: This will be the entity from whom the Contract Service Provider purchased the Product i.e the “Distributor”.
We will disclose this data to the Distributor, so that they can:
• provide customer service and support in relation to the Product, the Product Software and/or the Service, if and when you contact us/them and ask us/them to do so;
• communicate/correspond with us about customer service and support issues, faults and/or maintenance issues you are experiencing / have experienced in respect of the Product, the Product Software and/or the Service.

Amazon: If (and only if) the owner of the Premises has linked the Service with Amazon’s Alexa service, so that he/she can submit questions to the Service via Alexa about the status of the Product, then your data may be disclosed to Amazon.

When the owner of the Premises submits questions to the Service via Alexa about the status of the Product, the Service (and not Amazon) will automatically review the data held on our cloud servers to find the answer to the question asked of it. The Service will create a text instruction (i.e. the answer to the question, which may contain Operational Information) and send it to Amazon for Alexa to read out (e.g. “221b Baker St alarm was last activated on 6 January 2018”). Other than the text instructions that are created when questions are submitted to the Service via Alexa, we will not send any other data to Amazon.

Amazon will control, store, process and transfer the data it receives from us in accordance with their Privacy Policy. For information about the data controllers who form part of Amazon and about how those data controllers will store, process and transfer your data, please read Amazon’s Privacy Policy.

We may also need to share your personal data with other third parties:
•    where disclosure of the information is in our legitimate interests (i.e. for the success, growth and protection of our business), including:
o   with prospective sellers or buyers of businesses or assets, if we plan to sell or buy any business or assets, but we will only do so after the prospective seller or buyer has entered into an agreement with us to protect the confidentiality and security of your personal data;
o   if FireAngel Safety Technology Limited or substantially all of its assets are acquired by a third party, in which case personal data held by it about users of the Product/Product Software/Service will be one of the transferred assets;
o   in order to enforce or apply the EULA and/or any other agreements or to investigate potential breaches and/or to protect the rights, property or safety of FireAngel Safety Technology Limited, our customers, or others.

•    where disclosure of the information is necessary for compliance with a legal obligation to which we are subject, including:
o   if we are under a duty to disclose or share your personal data in order to comply with any legal or regulatory obligation or request, in which case we may have to disclose your personal data to law enforcement agencies and regulatory authorities.
We may allow other IT service providers to handle your personal data if we are satisfied that we have a legal basis to share the same with them and they take appropriate measures to protect your personal data.

5.      WHERE WE STORE YOUR PERSONAL DATA
Personal data you provide to us by corresponding with us by telephone, email or otherwise will be stored at our offices (at FireAngel Safety Technology Limited, Vanguard Centre, Coventry, CV4 7EZ).

Information which we collect from and about you will also be stored using the Amazon Cloud service, via an account which we control and administer., and held on servers within the European Economic Area (“EEA”).

6.      HOW LONG WE WILL KEEP YOUR PERSONAL DATA
We will hold your personal data for as long as your subscription to the FireAngel connect system (i.e. the Service) remains live, plus 1 year;

We will not retain and process your personal data other than for the purposes set out in this Privacy Notice.

When it is no longer necessary to retain your personal data, we will delete or anonymise it.

7.      YOUR RIGHTS
You have the following rights in respect of your personal data, which may be exercised free of charge (unless the request is manifestly unfounded or excessive, in which case we may charge a reasonable fee or refuse to act on the request):

The right to be provided with a copy of your personal data.

The right to require us to correct any mistakes in your personal data.
Right: To be forgotten
The right to require us to delete your personal data – in certain situations.
Right: Restriction of processing
The right to require us to restrict processing of your personal data — in certain circumstances (e.g. if you contest the accuracy of the personal data).

The right to receive the personal data you provided to us, in a structured, commonly used and machine-readable format and/or transmit that data to a third party — in certain situations.

The right to object:

·   at any time to your personal data being processed for direct marketing (including profiling);

·    in certain other situations to our continued processing of your personal data (e.g. processing carried out for the purpose of our legitimate interests).

Right: Not to be subject to automated individual decision-making
The right not to be subject to a decision based solely on automated processing (including profiling) that produces legal effects concerning you or similarly significantly affects you.

•                  let us know what right you want to exercise and the information to which your request relates.

8.      KEEPING YOUR PERSONAL DATA SECURE
We have appropriate security measures to prevent your personal data from being accidentally lost, or used or accessed unlawfully. Those processing your information will do so only in an authorised manner and are subject to a duty of confidentiality.
We have procedures in place to deal with any suspected data security breach. We will notify you and any applicable regulator of a suspected data security breach where we are legally required to do so.

We hope we can resolve any query or concern you may raise about our use of your personal data (see below ’How to contact us’).
The General Data Protection Regulation also gives you the right to lodge a complaint with a supervisory authority, in particular in the European Union (or European Economic Area) state where you work, normally live or where any alleged infringement of data protection laws occurred.
